What is consumer-rights mediation?

In accordance with articles L.616-1 and R.616-1 of the French Consumer Code, EnerLab Academy offers a consumer-rights mediation scheme. Mediation is an alternative dispute resolution mechanism, free of charge for the consumer, designed to settle disputes between a professional and a consumer amicably.

The mediator may only be contacted once internal remedies have been exhausted (a written complaint filed with EnerLab Academy with no satisfactory resolution within 2 months).

EnerLab Academy is affiliated with MCP Médiation as its designated consumer-rights mediator. Other mediators referenced by the French Commission for the Evaluation and Control of Consumer Mediation (CECMC) may also have jurisdiction.

Eligibility criteria

To refer a dispute to the mediator, you must:

  • Have previously filed a written complaint with EnerLab Academy
  • Have received no satisfactory response within 2 months
  • Be acting as a consumer (a natural person acting for non-professional purposes)
  • The dispute must not be manifestly unfounded or abusive
  • The dispute must not already have been the subject of a final court decision

Prior complaint

File your complaint with EnerLab Academy through our form. Wait 2 months without a satisfactory response.

Refer to the mediator

Refer the case to MCP Médiation by post or via their online form. Attach all supporting documents.

Review

The mediator has 90 days to issue an opinion. You are free to accept or refuse the proposed resolution.

Mediation does not waive your right to take legal action. You may also refer the matter to the European Online Dispute Resolution platform: ec.europa.eu/consumers/odr
